People should comment on this.

HSA expansion increases individual rights in healthcare. However many questions remain unanswered.

A story to illustrate:

I have $100 I want to deposit into an HSA every month. It's just enough to cover my monthly DPC office fee, plus all my labs and medications. 

There are 3 financial benefits to me, and multiple healthcare freedom benefits

I can deposit into an HSA income tax free. 

All HSA interest grows tax-free.

I can spend it on healthcare, tax-free.

My money, my healthcare, my say. My economic voice.

It's private - no state or federal database, no managed care.

People on the border of qualifying for Medicaid could live more securely, and remain independent. States benefit from smaller welfare rolls.

Obamacare/ACA barrier

WAIT - to legally deposit into an HSA, I would have to pay an insurance company for a wrap-around managed care health plan - over $700 per month!

A $700+ toll to deposit $100 is highway robbery.

It was a sweetheart deal by Congress, Big Insurance, and federal regulators passing the ACA/Obamacare. Their rules reduced HSA to mostly a Big Employer benefit, a way for insurance to control care. 

This Dec. 23 IRS email answered several of my questions. 

The Treasury Department and the IRS are seeking public input on new tax benefits for Health Savings Account (HSA) participants under the One, Big, Beautiful Bill. Notice 2026-05 explains changes that make more people eligible to use and contribute to HSAs.

Under the new rules:

  • People can still use telehealth and remote care services without losing eligibility to contribute to an HSA, even if they haven’t met their high deductible.
  • Starting January 1, 2026, bronze and catastrophic health plans count as HSA -compatible plans, which lets more people contribute to HSAs.
  • People in some direct primary care plans can also contribute to an HSA and use HSA money tax-free to pay certain periodic direct primary care fees.

Use the Federal e-Rulemaking Portal to submit comments by March 6, 2026, on these changes before final rules are issued.

However, many more questions remain.

  • Can I deposit into an HSA to pay for DPC, without purchasing an HDHP?
  • My DPC gets me the most affordable labs and prescriptions I've ever seen - usually only $4 each. It is perverse for this rule to exclude them under this rule change. Please remove that provision.
  • My DPC pairs well with health sharing membership; not with insurance plans. This expansion to Bronze and Catastrophic plans is great for some, but it doesn't go far enough. Please expand HSA-qualified spending to include health sharing membership and insurance premiums.
  • Why are HSA contributions capped? Managed care is a joke. People need flexibility for their care, and independence from insurance plans will help.
  • Rules should allow HSA participants to donate funds to other individuals, including friends, relatives, neighbors, and strangers. Individual charity does far more for real healthcare needs than insurance subsidies.

If you want to take back your healthcare, you should submit a comment to the IRS. Explain how HSA changes would (or could) benefit you, our state, and our country.
