Agenda January 25, 2024: expanding mental health scope of practice

Which clinicians may certify an individual for court-directed, involuntary admission for mental health/substance use treatment?

What about authorizing physical restraints and seclusion?

Who pays for all this? 

HB 5114 would expand numerous portions of the Michigan Mental Health Code to include a physician assistant,
certified nurse practitioner, and clinical nurse specialist-certified.

Current law allows only a physician or psychologist to do so. Both are in short supply, a function of licensing and scope of practice limits. These feed into elevated fees and professional ego/prestige, aside from whatever good they may accomplish.

Expect strenuous opposition and arguments about the importance of habeus corpus from the physician lobbies at hearings.

Opposition to current habeus corpus under the law itself - not so much.

Scope of practice is up this week, and it has lots of company in the revised agenda.

Fun fact: Naloxone/Narcan used to cost $4. What with Michigan stocking it in libraries and other public facilities, and installing hundreds of vending machines, the cost has risen considerably and shortages occur. This scenario is repeated in many other states as well.

Then the FDA approved Narcan over-the-counter sale nearly a year ago, no prescription needed. With easy public access, the cost was expected to fall and supplies increase.

But in a move guaranteed to put us right back into shortages and higher prices, here we have another bill to dispense it at public expense.

When the Founders said government is instituted to secure rights to life, liberty, and property, one doubts they had in mind the destruction of individual responsibility.
